Summary
The alleged clash in this case was between the bathroom equipment and accessories in classes 11, 20 & 21 and the hotel activities of the opponents; the opponents also claimed to have ‘moved into’ the sale of bathroom products, all using the mark ‘RENAISSANCE’.
Having examined all the evidence, however, the Hearing Officer did not accept that the use of the mark applied for would be detrimental to the character or respect of the opponents’ mark and he further found no likelihood of damage to the opponents’ goodwill or reputation.
The opposition accordingly failed under both section 5(3) & 5(4)(a)
